Hotel Maison Victoire – Terms and Conditions

The establishment reserves the right to modify or adapt these General Terms and Conditions of Sale at any time. The applicable conditions are those in effect on the date the reservation is made by the customer. These General Terms and Conditions of Sale are drafted in French. In the event of a translation into one or more foreign languages, only the French version shall prevail in the event of a dispute.

Article 1 – Identification of the Establishment
Hôtel Maison Victoire is published and operated by the company VICTOIRE, a limited liability company with a share capital of 5,000 euros, registered with the Trade and Companies Register (RCS) of Pointe-à-Pitre under number 884 093 238, with its registered office located at 24 rue Barbès, 97110 Pointe-à-Pitre, Guadeloupe.
The company's intra-community VAT number is FR93884093238.

These General Terms and Conditions of Sale govern all reservations made with Hôtel Maison Victoire, regardless of the booking channel used.

Article 2 – Purpose and Scope
The purpose of these General Terms and Conditions of Sale is to define the rights and obligations of the parties regarding reservations and stays at Hôtel Maison Victoire.
The establishment provides hotel accommodation services as well as supplementary services such as breakfast, a bar, and a café. The services offered constitute simple stays and do not fall under the regulations applicable to "package tours" as defined by the French Tourism Code.
Reservations can be made via the hotel's website, by telephone, by email, directly at the establishment's reception, or through third-party booking platforms such as Booking.com, Expedia, or Airbnb.
When a reservation is made through a third-party platform, that platform's own terms and conditions may apply in addition to these General Terms and Conditions of Sale. In the event of a conflict between the platform's terms and those of the establishment, the platform's specific provisions regarding the booking process may prevail for aspects related to its service.
Every reservation implies full and unreserved acceptance of these General Terms and Conditions of Sale.

Article 3 – Reservation Conditions
Reservations for a stay at the establishment are restricted to persons at least eighteen years of age with the legal capacity to enter into a contract. At the time of booking, certain personal information is required to process the registration and management of the stay. The customer agrees to provide accurate and complete information, including their first and last name, a valid email address, and a phone number.
Reservations are strictly personal (nominative). However, they may be transferred to a third party provided that the establishment is informed in advance by email. Upon arrival at the hotel, a valid form of identification may be requested to verify the customer's identity.
Special Requests and Stay Preferences Any special requests made by the customer at the time of booking, including those regarding room location, floor, view, or any other preference, will be taken into account whenever possible. However, these requests do not constitute a contractual commitment by the establishment and cannot be guaranteed. Therefore, the customer shall have no right to compensation or a refund if these preferences cannot be met.
Description of Services and Classification Information regarding the services offered by Hôtel Maison Victoire—including descriptions, amenities, services, and photographs appearing on the website or any communication medium—is provided for informational purposes to present the establishment's characteristics. The comfort level (star rating/classification) assigned to the hotel in the website descriptions corresponds, where applicable, to a classification established in reference to the local standards of the country concerned. This classification may differ from French standards and is provided for indicative purposes only.

Article 4 – Right of Withdrawal (Cancellation Policy)
In accordance with the provisions of Article L221-28 of the French Consumer Code, the right of withdrawal applicable to distance contracts does not apply to accommodation services provided on a specific date or for a specific period. Consequently, any reservation made with Hôtel Maison Victoire is firm and final upon confirmation.

Article 5 – Pricing
Prices for rooms and services are indicated in Euros, inclusive of all taxes (VAT included). Depending on the booking channel used, the tourist tax (taxe de séjour) may be included in the displayed price or may be payable directly on-site at the time of the stay. The establishment reserves the right to modify its rates at any time. However, the price applied to the customer will always be the rate in effect at the time the reservation was confirmed.
Reservations made with the establishment are non-refundable, unless otherwise required by mandatory legal provisions.

Article 6 – Terms of Payment
Payment for the stay is required at the time of booking. Accepted methods of payment include credit/debit cards, cash, and bank transfers. At the time of booking, the establishment may perform a credit card pre-authorization for a security deposit in the amount of 100 euros. This pre-authorization covers potential damages, breakages, or unpaid services. By confirming the reservation, the customer expressly authorizes the establishment to charge the credit card provided for any amounts remaining due at the end of the stay, particularly in cases of damage, theft, or unpaid consumption.

Article 7 – Group Reservations
Reservations for multiple rooms, specifically four or more, may be subject to special conditions. In such cases, the establishment may provide a specific quote, request a down payment (deposit), and apply specific booking or cancellation terms. When special conditions are established for a group reservation, these shall prevail over these General Terms and Conditions of Sale.

Article 8 – Stay Conditions
Rooms are made available to guests starting at 3:00 PM. Arrivals are possible until 9:00 PM. Any late arrival must be reported to the establishment and receive prior validation.
Rooms must be vacated no later than 11:00 AM on the day of departure. No late check-outs are offered. Staying past this time may result in the billing of an additional night.
Minors remain under the exclusive responsibility of their parents or legal guardians throughout the stay. Pets are not allowed within the establishment.
The establishment is not accessible to persons with reduced mobility and does not have specific adaptations. It is the customer's responsibility to ensure that the facilities meet their needs before making a reservation.

Article 9 – House Rules
Hôtel Maison Victoire is an establishment on a human scale that prioritizes peace and respect for the neighborhood. Customers agree to behave respectfully toward the premises, staff, and other occupants. Noise disturbances, in-room parties, or any behavior likely to disturb the tranquility of the premises are strictly prohibited, especially between 11:00 PM and 7:00 AM.
Room occupancy is limited to two adults. Hosting unregistered guests is prohibited.
In the event of a serious breach of the house rules or inappropriate behavior, the establishment reserves the right to terminate the customer's stay, following a formal notice that remains unheeded, except in cases of emergency or manifest disturbance.

Article 10 – Access to Restricted Areas
Certain areas of the establishment are strictly reserved for staff, including the kitchen, the bar (when closed), the laundry room, the reception desk, and the luggage storage area. For reasons of safety, hygiene, and insurance, guests are strictly prohibited from entering these areas without prior authorization. Any intrusion into these zones may result in eviction from the establishment and billing for any damages caused.

Article 11 – No Smoking Policy
In accordance with current regulations regarding smoking in public places, smoking is strictly prohibited in the rooms as well as in all indoor areas of the establishment. In case of non-compliance, cleaning and restoration fees may be charged to the customer.

Article 12 – Cancellation, No-Show, and Early Departure
Reservations made with the establishment are non-refundable.
In the event of a no-show on the scheduled arrival date, the total amount of the reserved stay remains due. Similarly, in the event of an early departure, the full amount of the originally reserved stay remains payable.

Article 13 – Overbooking
In the event of involuntary overbooking, the establishment agrees to offer the customer relocation to an establishment of an equivalent category, subject to availability. If no relocation can be offered, the establishment will proceed with a full refund of the sums paid.

Article 14 – Liability
The hotelier’s liability is governed by the provisions of Articles 1952 et seq. of the French Civil Code. The establishment shall not be held liable for temporary interruptions of services beyond its control, such as water or power outages or loss of internet access.

Photographs presented on the website or communication materials are for illustrative purposes and are not contractually binding. Minor variations may exist, particularly due to changes in furniture or decor.

Article 15 – Security of the Establishment
Hôtel Maison Victoire implements the necessary measures to ensure the safety of persons and property in accordance with regulations applicable to establishments open to the public (ERP).
The establishment is equipped with a fire alarm system, fire extinguishers, evacuation plans, and emergency exits. A video surveillance system is also installed in common areas to guarantee the safety of property and persons.
Staff is present on-site from 6:30 AM to 9:00 PM (Sunday to Wednesday) and from 6:30 AM to 10:30 PM (Thursday to Saturday). Outside of these hours, the establishment operates without a night watchman. Guests nevertheless have secure access to their rooms.
Each guest agrees to comply with the safety instructions posted within the establishment and to behave responsibly throughout their stay. Guests are specifically responsible for ensuring the entrance door of the building and the doors and windows of their room are closed, and for reporting any abnormal or potentially dangerous situation to staff immediately. Safety equipment, including extinguishers and fire alarms, must not be handled or used without justification and may only be used in case of actual necessity or emergency. In the event of an incident requiring immediate intervention, the guest is invited to contact the appropriate emergency services by dialing 15, 17, 18, or 112. Any improper or unjustified triggering of the alarm system, or misuse of safety equipment, may result in the customer being billed for costs incurred by the establishment, including those resulting from emergency service intervention.

Article 16 – Damage and Breakage
The customer is required to use the premises peacefully and respect all equipment, installations, and property provided. The customer is responsible for any damage, breakage, or loss caused in the room or common areas during their stay, whether committed by themselves or by persons under their care.
If damage is discovered, including after the customer’s departure, the establishment reserves the right to bill the cost of repairs, equipment replacement, or necessary restoration fees.
The establishment displays artworks, decorative objects, and valuables in its common and private areas, as well as products for sale in its boutique. The customer agrees to respect their integrity and not to handle them without authorization when they are not intended for sale or direct guest use.
Any theft, disappearance, or deterioration—whether of a decorative object, artwork, equipment, or retail item—may be billed at its replacement or repair value. The corresponding amounts may be deducted from the security deposit or charged to the credit card provided at the time of booking, after notifying the customer.

Article 17 – Personal Belongings and Lost Property
Personal belongings of guests remain their responsibility throughout the stay, in accordance with legal provisions applicable to hotels.
Items left at the establishment after the guest's departure may be kept for a maximum of three months. After this period, they may be destroyed or donated to a charitable organization.
At the customer’s request, found items can be shipped to a provided address; shipping costs remain the responsibility of the customer.

Article 18 – Protection of Personal Data
Personal data collected during reservations is necessary for managing stays and complying with legal obligations applicable to the hotel industry. This data may be kept for accounting and tax purposes for a maximum of ten years.

In accordance with the General Data Protection Regulation (GDPR), every individual has a right to access, rectify, delete, and object to their personal data.
Telephone Solicitation and the BLOCTEL Opt-out List In accordance with the provisions of Articles L223-1 et seq. of the French Consumer Code, the customer is informed of their right to register for free on the "BLOCTEL" telephone solicitation opt-out list at www.bloctel.gouv.fr.
When the customer provides their phone number to the establishment, it is used solely for the execution of the reservation and the customer relationship. The establishment agrees not to engage in telephone solicitation in violation of applicable regulations.

Article 19 – Insurance
Hôtel Maison Victoire maintains professional multi-risk insurance, including professional civil liability coverage, covering risks related to its hotel activities.
This insurance is held with PACIFICA, a company governed by the French Insurance Code, with its registered office at 8/10 boulevard de Vaugirard, 75724 Paris Cedex 15, under policy number 8809224906.
This coverage includes the civil liability that the establishment may incur toward third parties in the course of its activity, subject to the conditions and limits provided in the contract.

Article 20 – Complaints and Mediation
Any complaint regarding a stay must be sent in writing to the establishment within thirty days following the end of the stay, to the following email address: contact@maisonvictoirepap.com.
In the event of failure to reach an amicable resolution, the customer may contact a consumer mediator, to which the establishment will soon adhere. The mediator’s contact details will be provided upon effective membership.
Abusive Complaints and Bad Faith All complaints must be made in good faith and in a spirit of amicable resolution. The customer agrees to report, whenever possible, any difficulty encountered during the stay to allow the establishment to provide an immediate solution. No request for a refund or compensation will be considered for an inconvenience that was not reported during the stay, unless there was a legitimate impossibility to do so.
The establishment reserves the right to refuse any request that is clearly abusive, disproportionate, or made in bad faith, particularly when it is not based on objective evidence or is submitted late without justification.

Article 21 – Governing Law and Jurisdiction
These General Terms and Conditions of Sale are governed by French law. If any provision of these General Terms and Conditions of Sale is declared null, invalid, or unenforceable by a competent jurisdiction, the other provisions shall remain fully applicable and retain their full force and scope. In accordance with the provisions of the French Consumer Code, the customer may bring the matter before the competent jurisdiction according to standard legal rules.
